Wal-Mart Parking, lawsuit

Doesn't Wal Mart (and other big companies) have staff salaried exempt lawyers who would defend some of these smaller cases at less cost rather than just settle? Also couldn't Wal Mart appeal some of the cases it loses, enough to make some of the contingency fee plaintiff lawyers want to give up?
